Fondo Real de Cholula Digital Collection

The Fondo Real de Cholula, housed in the Archives of the Judicial Branch of the State of Puebla, comprises records of legal proceedings spanning from the 16th century to the beginning of the 20th century. A careful analysis of the Fondo Real de Cholula indicates that, together with the collection protected in the General Archive of Notaries of the State of Puebla, it forms the archive of the Corregimiento de Cholula. This institution was founded in the 16th century and then it became known as the Main City Hall in the 17th century. In 1821, it became the Constitutional City Council in accordance with the division of powers and the three levels of government (federal, state, and municipal) of the recently established Federal Republic.The fact that the Fondo Real de Cholula extends beyond the novohispano period to also cover the nineteenth and twentieth centuries means that it is a unique collection for the study of changes in the legal system. However, the repository is mostly unique in that all other Cholula files were looted or burned during the violence experienced in the Mexican Revolution, thus making this collection fundamental for the region.

The Fondo Real de Cholula is of the utmost importance because it contains the documentation of the old corregimiento of Cholula, one of the nine "Cities of Indians" that existed in New Spain, which accounts for documentation of the Corregimiento and then the City Hall. These institutions were district seats and therefore had the powers of government, law, finance, and war over Indigenous villages, and also over the Spanish, Black, Mestizo, and Creole populations. The jurisdiction covered a large territory that today includes the municipalities of San Andrés Cholula, Cuauhtlancingo, and Coronango, among others. There are records in the collection of the four functions of the institution. 1) Government: proceedings, royal decrees, ordinances; 2. Justice: civil and criminal proceedings; 3. Treasury: financial documents delivered by the Republics of Indians under the jurisdiction of the corregimiento/municipality; 4) War: there are various provisions on the levying or seizure of goods (bread, weapons, donkeys, mules) in cases which necessitated it . The latter is exclusively about the non-Indigenous population.

The collection is of singular importance considering the findings of recent historiographical studies which have concluded that the legal system and related processes were fundamental for the integration of Indigenous populations into the regime of the Hispanic Monarchy without major uprisings or social movements. The broad temporal context of the collection means that it is possible to trace how the legal system and local history of a “Republic of Indians”-turned-city became part of the founding of the nation-state, a rarity in Spanish America.

Se conoce como Fondo Real de Cholula un acervo resguardado en el Archivo del Poder Judicial del Estado de Puebla, el cual incluye expedientes desde el siglo XVI hasta 1900, ininterrumpidamente, en materia de justicia. Un análisis cuidadoso del Fondo Real de Cholula nos indica que, junto con el acervo resguardado en el Archivo General de Notarías del Estado de Puebla, conforma el archivo del Corregimiento de Cholula, institución fundada desde el siglo XVI, transformada en el siglo XVII en Alcaldía Mayor, misma que subsistió hasta en 1821, cuando se inició su transformación en Ayuntamiento Constitucional dentro del sistema de división de poderes y tres niveles de gobierno (federal, estatal y ayuntamiento) de la estructura política propia de la República Federal conformada. El hecho de que el Fondo Real de Cholula no se limita al periodo novohispano, sino que abarca también el siglo XIX y XX, le otorga una calidad excepcional para poder estudiar los cambios en el sistema de justicia. Sin embargo, el valor principal de este repositorio es que todos los demás archivos de Cholula fueron saqueados o quemados durante los procesos violentos vividos en la Revolución Mexicana, siendo este archivo de una importancia fundamental.

El Fondo Real de Cholula es de suma importancia debido a que contiene la documentación del antiguo corregimiento de Cholula, una de las nueve Ciudades de Indios que existieron en la Nueva España, de lo cual da cuenta un acervo que contiene documentación del Corregimiento y después Alcaldía Mayor. Estas instituciones se asentaban en la cabecera de la jurisdicción y por lo tanto tenían facultad de gobierno, justicia, hacienda y guerra en los pueblos de indios y también sobre población española, negra, mestiza, criolla, etc., asentada en un amplio territorio que incluye hoy a los municipios San Andrés Cholula, Cuauhtlancingo, Coronango, etc. En el acervo se encuentran expedientes de las cuatro funciones de la institución. 1) Gobierno: actas, cédulas reales, mandamientos, etc.; 2. Justicia: procesos civiles y criminales; 3. Hacienda: documentos de cargo y data que entregaban las repúblicas de Indios bajo la jurisdicción del corregimiento/alcaldía; 4) Guerra: encontramos diversas disposiciones sobre la leva o incautación de bienes (pan, armas, burros, mulas de carga) en casos necesarios. Esto exclusivamente sobre la población no indígena.

El acervo es de singular importancia dado que ha sido aceptado por la historiografía reciente que la impartición de justicia fue un elemento fundamental para la integración de los indígenas al régimen de la Monarquía Hispana, sin mayores alzamientos ni movimientos sociales en resistencia. Estudiar este proceso en un contexto temporal amplio, permite darle continuidad al estudio de la impartición de justicia durante el proceso de conformación del Estado Nacional a partir de la historia local de una ciudad que fue República de Indios, lo cual es poco frecuente en la América hispana.
